Nelson Hardiman achieved a significant victory on behalf of a sober living home facing criminal charges in the City of Los Angeles. The charges, based in part on the City’s mischaracterization of the home as an unlicensed community care facility and misapplication of the Los Angeles City Municipal Code, threatened to shudder the home by imposing occupancy limits which are inapplicable to sober living homes pursuant to state and federal law. Despite being retained after an informal resolution had failed and charges were filed, Nelson Hardiman successfully convinced the City to drop all licensing and occupancy charges, and to dismiss its case against the sober living home and the property owner. As a result, individuals recovering from addiction continue to live in the sober living home of their choice.
