For over 25 years, the federal Fair Housing Act and Americans with Disabilities Act have protected small residential addiction treatment programs and sober living facilities from local land use oversight.  These legal protections have been essential in ensuring needed access to care and combatting discrimination against recovering addicts by neighbors voicing “Not In My Back Yard” (NIMBY) concerns about the nuisance, safety, and property value impact of living near addiction treatment facilities. While federal and state law have protected residential treatment and sober living facilities, a new wave of backlash has emerged across California, with cities asserting the need for local ordinances to limit the proliferation of addiction treatment programs. These ordinances assert greater control and numerous requirements on operators that raise serious legal issues, such as density limitations and detailed operational requirements. Cities have also attempted to pass state legislation for greater local empowerment and the imposition of more constraints on multi-site operators and to limit “clustering” of multiple small facilities. This “pendulum swing” is highly concerning to many in the industry based on the anticipated legislative and legal battles ahead to ensure access and fight off NIMBY-driven discrimination. It is also destabilizing to operators, investors, and prospective acquirers who are uncertain about how the industry land use regulations are likely to evolve.
